Bad News...
Mark at Terminal Reality said that I can not release patches, due to the fact that Microsoft own's the rights to that game. The only reason that the guys that are doing 4x4 Evo Revolution is because Terminal Reality owns those rights. So I can look at the code and use it somewhat for knowledge on my own game MFR I guess. Sorry, that no patches are going to be allowed.

You know nothing really is stopping it from being called anything else, and then having the community provide all new content. Think about it, this game does not even have 1/8th (Maybe even less) of the content 4x4Evo has. And there are a lot of people here that can probably sort that. 
If the code alone was the issue, I would have had to stop 4x4EvoR ages ago which is just this engine massively updated.

What about free mods? ... That just happen to include the exe of the game?
It's not unheard of. Off the top of my head, vampires bloodlines has mods of the main game to fix bugs.

A lot of games, including Microsoft games, have mods (Age of Empires for example) but they were usually hacks, not written straight from the source code.

Microsoft won't even be aware of the game anymore.

Since forever. TRI has the rights to the actual code but Microsoft has rights to the final completed product.

im confused since the game has been abandonware since....forever. How else could it be user modified if a company still had rights to it? I mean the company didnt create traxx/and etc. so this makes no sense to me

If Microsoft so felt like swinging its knarly *beep* and beating our heads with it, it could and there's nothing we could do to stop it.
Our only hope is that we stay under the radar. Which we were doing pretty well of until some news website shows the mtm2 web page on microsoft.com. Reminding microsoft that this game exists.
